OFFICIAL RULES AND REGULATIONS ELIGIBILITY You must be 18 years of age or older to donate and participate in the ACF raffle.
Only one (1) individual may be identified as the donor for the raffle entry.
All federal, state and local laws and regulations apply. Void where prohibited. Entries will be made by donations and only via the Internet.
All donations are non refundable per IRS rules.
All communications, including the email ticket confirmation, will be sent to the email address supplied during the donation process.
It is the donor's responsibility to provide a valid, deliverable mailing address and email address to: American Cancer Fund.Org; and ACF/ACES its agents, Board, vendors, volunteers and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified.
ACF/ACES employees and Board members are not eligible to participate in this Raffle.
ACF/ACES decision shall be final. ACF/ACES may at any time modify, revise, or update the Official Rules to correct any errors, omissions or changes to the Raffle, in its sole discretion.
By entering the Raffle, the donor acknowledges that he or she is aware of and is bound by all of the official raffle rules.
COST Each entry is $30.00. You can get 4 entries for $110.00. Each entry is non refundable.
DRAWINGS A maximum/minimum of 4,000 entries will be sold for the Raffle.
All entries must be received by 11:59 p.m. EST on May 28, 2010 to be eligible for this drawing. Drawing takes place on May 31, 2010. Should all 4,000 entries be sold prior to stated drawing date, then the drawing will occur three days after the maximum entries have been reached.
PRIZES The winner of the Grand Prize ("GPW") is entitled to the car or $33,600.00 in cash as an alternative. Within 30 days of notification by ACF, GPW may select the cash alternative by providing ACF with e-mail notification of their selection of either: (i) the payment of the $33,600.00 cash prize will be made within thirty (30) days following ACF receipt of GPW's notification of acceptance of this option. (ii) If the Car is selected, then the GPW will be informed as soon as arrangements are made with the dealer. GPW then must supply ACF with any and all requested documentation. Car is subject to availability. Car comes factory equipped and winner is solely responsible for any and all shipping and handling costs and state or local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to possession) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the winner and negotiated with the dealership. The car is subject to availability at the automobile dealer and may be substituted with a comparable vehicle by GPW. The vehicle is delivered F.O.B. Location. 115 additional prizes will be awarded. Prizes may not be exactly as shown, are based on manufacturer availability and may be substituted with a prize of similar value. The approximate value of all combined prizes including the car is over $47,000 MSRP (manufacturer's suggested retail price) and is based on estimated MSRP pricing at the time of prize selection. No prize is valued at less than $100.00 MSRP. The odds of winning a prize are dependent upon the number of valid entries received, but shall be no less than 1-in-35. The statement of 1-in-35 chance to win a prize is based on the donation of a single ticket, 4,000 total tickets being issued. In the event of a winning entry having more than one name, ACF will award the prize to the first name listed on the entry. Records of ACF shall be deemed correct if there is any discrepancy. ACF is not responsible for resolving any disputes that may arise from different individuals listed on a raffle certificate. With proper transfer documents bearing notarized signatures, as required by the Raffle, a prize may be transferred. Winners are responsible for all shipping and handling costs.
NOTIFICATION OF WINNERS All winners will be notified via e-mail or by phone of the prize won and any requisite procedures to claim the prize. Winners will be required to pay shipping charges on all prizes. In California, winners may also be charged a state mandated disposal fee. Only winners' first name and last initial and locations by city or town, and state, will be posted at www.americancancerfund.org. If a selected winner is unable to be contacted or located after a period of forty (40) days from the draw date of any raffle drawing, the prize or its cash equivalent will be deemed to have been donated to ACF for use by their charitable organization. All contact attempts shall be made to the address and email address provided by the raffle entry contributor. All winners, by entering, authorize ACES to publish their name and likeness on the website and for it to be used in other promotional materials by ACF/ACES.
TAXES AND IRS RULES All winners shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prizes. All cash prizes will be paid net of applicable income tax withholding. The IRS requires that income tax withholding on prize values of $5,100 or greater must be paid upon award and distribution. Government rules governing withholding can change without notice. The American Cancer Fund Charity Raffle will follow the rules in effect at the time the prizes are awarded. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution. Check with your qualified financial advisor for additional information.
WAIVER/LIMITATIONS OF LIABILITY Entry donors, by participating (and winners, by accepting a prize) release American Cancer Fund/ American Cancer Educational Services, Inc. and its respective board, committee members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of ACF/ACES shall be limited to ticket price paid and in the case of any dispute, ACF/ACES decision shall be final. ACF/ACES may at any time modify, revise, or update the Official Rules to correct any errors, omissions or changes to the Raffle, in its sole discretion. By participating in the Raffle you accept and are bound by its rules.
